Terms & Conditions

These Terms & Conditions (“Agreement”) apply to every booking with South Beach Santa. They’re here to keep things merry, bright, and professional — so your holiday event runs smoothly and expectations are crystal clear.

General Policies

Booking & Deposits
  • A 50% non-refundable deposit is required at the time of booking to secure your date and time.

  • Your booking is not confirmed until the deposit is received.

  • The remaining balance is due 14 days prior to the event.

  • Failure to pay the remaining balance by the due date will result in automatic cancellation of your booking and forfeiture of the deposit.

Cancellation & Refunds
  • Client cancels >14 days before the event: deposit is forfeited; any balance already paid will be refunded.

  • Client cancels ≤14 days before the event: deposit and balance are forfeited (the date was held exclusively for you).

  • If South Beach Santa cancels (rare): you’ll receive a full refund of all amounts paid, plus the option of a complimentary personalized video greeting.

Rescheduling
  • Reschedules may be requested and are subject to availability.

  • Reschedules within 7 days of the event may incur a 25% rebooking fee.

  • We’ll do our best to accommodate reschedules, but availability is not guaranteed during the busy holiday season.

Force Majeure
  • Neither party is liable for cancellations caused by events beyond reasonable control (e.g., severe weather, hurricanes, power outages, illness, natural disasters).

  • We will make reasonable efforts to reschedule.

  • If rescheduling is not possible, any payments beyond the non-refundable deposit will be refunded.

Event & Services Policies

Travel & Arrival
  • Travel logistics and any applicable fees will be discussed and agreed upon during booking.

  • Please allow a 15-minute arrival window before or after the scheduled time due to traffic or holiday conditions.

  • If delays occur, Santa will still perform for the full contracted time.

Performance Conditions
  • Client provides a safe, suitable environment (parking, staging area, no unsafe props).

  • Guests must maintain appropriate behavior (no harassment, unsafe conduct, or inappropriate requests).

  • Santa may end the appearance immediately if conditions are unsafe or inappropriate; no refund will be issued in such cases.

Photography & Media Release
  • Clients may capture photos and video for personal use.

  • South Beach Santa may use photos/videos for promotional purposes unless you opt out in writing before the event.

  • Client images may not be used for commercial promotion without our written consent.

Substitution Clause
  • In rare circumstances, South Beach Santa may provide a professional substitute Santa of equal quality.

  • If no substitute is available, a full refund of all amounts paid will be issued.

Premium Dates & Pricing
  • Premium rates apply to peak dates (December weekends, Christmas Eve, etc.).

  • Pricing is confirmed when the deposit has been received.

Liability Waiver
  • South Beach Santa is not responsible for injuries, accidents, damages, or incidents occurring at the client’s location.

  • The client assumes responsibility for guest conduct and safety.
